This course focuses on the U.S. Constitution, examining constitutional principles, interpretation, and practice. Topics include federalism, separation of powers, judicial review, due process, equal protection, freedom of speech, religious freedom, and right to privacy. Through reading landmark cases, students understand the Supreme Court's methods of constitutional interpretation and how the Constitution shapes American political institutions and social life. The course emphasizes developing students' legal reasoning skills and constitutional thinking.
学生选择一个重要的宪法争议议题(如同性婚姻、平权行动、选举人团制度等),选取相关最高法院判例进行深入分析,并模拟撰写一份最高法院大法官意见书。要求梳理判例的法律推理逻辑,分析多数意见与异议意见的争论,阐述个人立场并提供宪法论据支持。意见书字数约2000字,需引用至少三个相关判例。
Students select a major constitutional controversy (such as same-sex marriage, affirmative action, or the Electoral College), conduct in-depth analysis of relevant Supreme Court cases, and write a simulated Supreme Court justice opinion. The paper should trace the legal reasoning of landmark cases, analyze debates between majority and dissenting opinions, and present a personal position supported by constitutional arguments. Approximately 2000 words with citations to at least three relevant cases.
